Spousal support termination date properly set 3 years after original order after lengthy marriage due to circumstances:

 

Summary:  Spousal support was premised, in part, on the expectation that wife would obtain retraining in order to increase her income and become self-supporting.  However, by three years later, Wife had done little, if anything, to obtain retraining to increase her income and had not otherwise been diligent in attemptin to become self-supporting.  

 

WIFE'S FAILURE TO DILLIGENTLY PURSUE RETRAINING IN ORDER TO ATTEMPT TO BECOME SELF-SUPPORTING CONSTITUTED A CHANGE OF CIRCUMSTANCES JUSTIFYING MODIFICATION OF SPOUSAL SUPPORT.

 

How this applies to this case:

 

     Petitioner has had since 2007 to prepare herself for the work market.  She has done little, if anything to seek occupation.

     She continues to make up excuses even though the court order specifically states that she has the training and talent to become      self supporting.  

 

Petitioner's failure to dilligently pursue work therefore constitutes a change of circumstances justifying modification--termination--of spousal support.
